Agreement to terms

These Terms and Conditions form a legally binding agreement between you and Lucia Water Solutions LLC concerning your access to and use of our website and services. By using our website or services, you agree to be bound by these Terms.

You must be at least 18 years old to use our services or enter into any agreement with us.

Services description

Lucia Water Solutions LLC provides free in-home water quality testing and analysis, whole house water purification system design and installation, reverse osmosis and alkaline water system installation, system maintenance and repair, and commercial water treatment solutions.

All services are subject to availability and may vary based on your location within our service area.

Free water testing

Our free water testing includes a complimentary in-home water quality analysis, a professional consultation and recommendations, and a detailed water quality report, with no obligation to purchase.

Free testing is available to residential properties within our service area, and we reserve the right to limit the number of free tests per household or property.

Pricing and payment

Pricing is provided through a personalized quote based on your specific water quality needs and property requirements, and prices are subject to change without notice.

Payment is due upon completion of service unless otherwise agreed in writing. We accept cash, check, credit cards and financing options subject to approval; financing terms are subject to third party approval and a separate agreement. Late payments may carry additional fees as permitted by law.

Installation and service

Installation and service appointments are scheduled based on availability, and we make reasonable efforts to accommodate your preferred schedule.

You agree to provide accurate information about your property, ensure access to installation areas, provide necessary utilities during installation, clear the work area, and be present or have an authorized representative present during service.

All installations follow industry standards and local building codes, and we reserve the right to adjust installation plans if site conditions require it.

Warranties and guarantees

Water treatment systems are covered by manufacturer warranties that vary by product, with terms provided at the time of purchase; coverage may include warranties of up to 25 years on certain systems, plus parts and labor coverage as specified in your documentation.

Warranties do not cover damage from misuse, neglect or improper maintenance, normal wear on consumable parts like filters and membranes, damage from events beyond our control, systems modified or repaired by unauthorized parties, or consequential or incidental damages.

Maintenance and service

Regular maintenance helps your system perform at its best, including filter replacements as recommended, annual inspections, and prompt attention to system alerts. Failing to maintain your system as recommended may void your warranty coverage.

Cancellation and refund policy

You may cancel or reschedule an appointment with at least 24 hours notice at no charge; cancellations with less notice may carry a fee.

Equipment orders can be cancelled before shipment or installation; once installation has begun, cancelling may involve fees for labor, materials and restocking. Refund eligibility is decided case by case, equipment must be returned in original condition, and completed installation services are generally non-refundable.

Limitation of liability

To the maximum extent permitted by law, our total liability will not exceed the amount paid for the specific service or product, and we are not liable for indirect, incidental or consequential damages, or for damages from improper use or maintenance.

Water quality results reflect testing at the time of service and may vary afterward; we cannot guarantee specific water quality outcomes due to variables beyond our control.

Service area

Our services are available within a 60 mile radius, primarily New York's Rockland, Orange, Westchester, Nassau and Suffolk Counties, and New Jersey's Bergen and Hudson Counties. Service outside these areas may be available on request and subject to additional fees.

SMS and text messaging program

Our SMS program sends service notifications, appointment reminders, water quality alerts and related messages about our services. Reply STOP to any message to opt out at any time; you'll receive one final confirmation message. Reply HELP or call 845-879-2900 for assistance.

Message frequency varies, and standard message and data rates may apply depending on your carrier. Carriers aren't liable for delayed or undelivered messages. Your consent to receive SMS messages is never a condition of purchasing any goods or services.

Intellectual property

All content on our website, including text, graphics, logos, images and software, belongs to Lucia Water Solutions LLC or its licensors and is protected by copyright and other laws. You may not reproduce, distribute or create derivative works without our written permission.

Dispute resolution

We encourage you to contact us first to resolve any concerns informally. These Terms are governed by the laws of the State of New York, and any legal action related to these Terms will be brought in the state or federal courts located in New York.

Changes to these terms

We may modify these Terms at any time. Changes will be posted on our website with an updated "Last Updated" date, and your continued use of our services after changes are posted means you accept the modified Terms.

Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.
